Welcome to Expert on Deck (“EOD,” “we,” “our,” or “us”).
Expert on Deck provides an online directory platform connecting homeowners, renters, and businesses (“Customers”) with qualified service professionals and contractors (“Service Professionals”).

By using our website, mobile app, or any related services (collectively, the “Platform”), you agree to these Terms and Conditions (“Terms”). If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy, which is incorporated by reference.
If you do not agree, you must not use or access our services.

2. Eligibility

You must be at least 18 years old to use the Platform.
By using Expert on Deck, you represent and warrant that:

• You have the legal capacity to enter into these Terms.

   

• If you are a Service Professional, you are legally authorized and properly licensed (where required) to perform the services you offer.
• Expert on Deck does not independently verify the licensing, insurance, or qualifications of Service Professionals. Customers are responsible for confirming the credentials of any professional before hiring or contracting services. Using the Platform does not create any guarantee regarding the quality, safety, or legality of services.
• You will comply with all applicable local, state, and federal laws.

   

We may terminate or suspend access to any user who provides false information or misuses the Platform.

3. Account Creation & Security

Some features require you to create an account.
You agree to:

• Provide accurate, current, and complete information.

   

• Keep your login credentials confidential.

   

• Accept full responsibility for all activity under your account.
• You are responsible for maintaining the confidentiality of your account login credentials. Accounts may be temporarily suspended or permanently deactivated after prolonged inactivity or for security reasons. Expert on Deck is not responsible for unauthorized access resulting from failure to protect your account information.

You must notify us immediately if you suspect unauthorized use.
We are not liable for losses resulting from your failure to safeguard account information.

4. User Roles and Responsibilities

For Customers:

• You may browse, contact, and hire Service Professionals through the Platform.

   

• You are responsible for independently verifying any professional’s qualifications, licenses, or insurance.

   

• You may post reviews or ratings but must do so honestly, without defamation or abuse.

   

For Service Professionals:

• You must provide accurate business details, including service area, pricing, and licensing (if applicable).

   

• You are responsible for compliance with all laws, tax obligations, and insurance requirements.

   

• Your profile, reviews, and ratings may be visible publicly and in search engines.

   

• You agree that customers may post reviews about your business, and that we may moderate or remove reviews to maintain integrity.

   

5. Use of Services / Acceptable Use

You agree not to:

• Misuse or disrupt the Platform, including attempting to access unauthorized areas or data.

   

• Users may not post false, misleading, or defamatory information; impersonate another person; use automated scripts or bots to access the Platform; or interfere with other users’ experience. Expert on Deck reserves the right to suspend or terminate accounts engaging in any prohibited activity.

   

• Harass, spam, or threaten other users.

   

• Engage in unlawful or fraudulent behavior.

   

• Collect or scrape data from the Platform without permission.

   

We reserve the right to suspend or terminate any account that violates these Terms.

6. Listings, Reviews, and Content

• Business profiles, ratings, and reviews are publicly visible and may appear in search engines.

   

• We reserve the right to edit, hide, or remove content that violates our policies or applicable law.

   

• Deleting your account does not guarantee removal of previously posted reviews or public content.

   

• By posting reviews, ratings, photos, or other content, you grant Expert on Deck a worldwide, royalty-free, non-exclusive license to display, reproduce, and distribute such content in connection with the Platform. Expert on Deck reserves the right to moderate, edit, or remove content that violates these Terms, our policies, or applicable law. Deleting your account does not automatically remove public content posted on the Platform.

   

7. Payments and Subscriptions

Expert on Deck offers both free and paid plans for Service Professionals.
If you subscribe to a paid plan, the following terms apply:

• Automatic Renewal: Subscriptions automatically renew unless canceled before the renewal date.

   

• Billing: Payments are processed through trusted third-party processors (e.g., Stripe or Klervo).

   

• Cancellation: You may cancel at any time through your account settings. Your plan will remain active until the end of the current billing period.

   

• Refunds: Unless otherwise stated, payments are non-refundable once a billing cycle begins.
• If a payment fails or is not received, your paid account may be temporarily suspended until payment is resolved. Continued use of paid features constitutes acceptance of any updated billing terms. Refunds are provided only as specified in the subscription terms.

We will provide a confirmation of subscription terms via email or account notification in compliance with California’s Automatic Renewal Law (Cal. Bus. & Prof. Code §17600 et seq.).

8. Communication and Notifications

By using our Platform, you agree that we may send you:

• By using the Platform, you consent to receive service-related communications such as requests, reminders, and updates. Marketing messages will only be sent if you have opted in and may be unsubscribed at any time via account settings. Users may also manage SMS, email, and in-app notifications preferences.

   

• Promotional messages or newsletters (you may opt out anytime).

   

Messages may be delivered by email, SMS, or in-app notifications.
You can manage your communication preferences in your account settings.

9. Intellectual Property

All content, software, design, and logos on the Platform are the property of Expert on Deck or its licensors.
You may not reproduce, copy, or distribute our materials without written permission.

By submitting reviews, images, or comments, you grant us a non-exclusive, royalty-free license to use, display, and promote that content in connection with our services.

10. Disclaimers and Limitation of Liability

Expert on Deck is a directory platform only and is not a service provider, contractor, or agent for any Service Professional. All services provided by professionals are at your own risk. Expert on Deck provides the Platform “as-is” and “as-available” and does not guarantee the performance, quality, or legality of any services. Certain statutory rights under California law may not be waived.

“As-Is” and “As-Available” Basis:
The Platform is provided without warranties of any kind, express or implied.
To the fullest extent permitted by law, Expert on Deck shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform or any interactions between Customers and Service Professionals.

11. Indemnification

You agree to indemnify, defend, and hold harmless Expert on Deck, its officers, employees, and affiliates from any claims, losses, or damages arising from:

• Your use or misuse of the Platform;

   

• Your violation of these Terms; or

   

• Your infringement of any third-party rights.

   

12. Termination

We reserve the right to suspend or terminate your account at our discretion for violations of these Terms.
You may terminate your account at any time through your account settings.

Sections regarding intellectual property, indemnification, disclaimers, and limitation of liability will survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
For users residing in California, certain rights under California law may still apply.

Any disputes will be resolved through binding arbitration or small claims court, except where prohibited by California law.
California residents retain their right to bring claims in small claims court or other appropriate forums.

14. Changes to These Terms

We may update these Terms periodically.
If we make material changes, we will notify users by email or through a Platform notice.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
